Privacy Policy

Chinook Hosting Corp (“Chinook”) has created this privacy statement ("Statement") in order to demonstrate our commitment to Subscriber privacy. Privacy on the Chinook Web site (the "Site") and in Chinook’s services ("Services") is very important to us. We do gather important information from our Visitors, Resellers, and Users, and are deeply committed to handling it with the utmost responsibility and integrity. Accordingly we have established this Policy Statement to communicate our information gathering and dissemination practices. We reserve the right to change this Statement at any time. Posting updates to this location will serve as notification.

Collected Information

We require Users and Subscribers who register to use Chinook's services ("Services") offered on our Site to provide us contact information, such as their name, company name, address, phone number, and e-mail address, and for Subscribers, financial qualification and billing information, such as billing name and address, credit card number, and the number of users within the organization who will be using the Services. For the purposes of this document “Users” are any individuals who make use of an authenticated account to consume Chinook Services, and “Subscribers” are entities that hold an agreement directly with Chinook or indirectly with Chinook through a Reseller for use of those Services. At the time you express interest in attaining additional information, or when you register for the service, we may also ask for additional personal information, such as title, department name, fax number, or additional company information, such as number of attorneys, support staff, etc.

Subscribers can opt out of providing this additional information by not entering it when asked. To distinguish the data types, required fields are so designated. Subscribers can update or remove their personal information at any time by logging in to the Chinook Web site and editing their Personal Information within Account Management. Subscribers can view their updated profile to confirm that their edits have been made.

Chinook uses the information that we collect to set up Services for Subscribers and Users. We may also use the information to contact Subscribers and Users to seek feedback on our Services, and to send information regarding our company or partners, such as promotions and events. Subscribers and Users may be invited to receive a Services-related newsletter by providing an e-mail address. Subscribers and Users are also asked to provide an e-mail address when subscribing to the Services, in order to receive a user name and password. We may e-mail information relating to Services, such as product updates and product releases. We may provide service notices through the Service itself or through Resellers.

Except as we explicitly state at the time we request information, or as provided for in the Reseller Agreement or Services Descriptions we do not disclose to any third party the information provided. All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective Subscribers and to bill for Services.

This billing information is not used by Chinook for any marketing or promotional purposes whatsoever.

Chinook uses a third-party intermediary to manage the credit card processing. This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Other third parties, such as content providers, may provide content on the Chinook Web site, but they are not permitted to collect any information nor does Chinook share any User information with these parties.

Subscribers of Chinook Services will be using the Site to host data and information ("User Data"). Chinook will not review, share, distribute, print, or reference any such User Data except as provided in the Chinook Reseller Agreement or Services Descriptions, or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the Reseller Agreement, Services Descriptions or Acceptable Use Policy, or as may be required by law.

Subscribers and Users are responsible for maintaining the confidentiality and security of their user registration and password.

Chinook may also collect certain information from visitors to and Subscribers and Users of the Site, such as Internet Protocol (IP) addresses. This information is logged to help diagnose technical problems, and to administer our Site in order to constantly improve the quality of the Service. We may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors, Subscribers, and Users and provide such information to third parties for our own performance analysis, and site productivity, traffic, or usage metrics purposes only.

If a User or Subscriber elects to use our referral service for informing a friend about our site, we ask them for the friend's name and e-mail address. Thereafter, Chinook will automatically send the identified friend a one-time e-mail inviting them to visit the site. Chinook does not store this information.

Cookies

When you use the Chinook Web site and some Chinook Services, we continually work to make that experience engaging, useful, and simple. When you connect with any of our Web sites, our Web servers may send a cookie to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to tell us whether Subscribers, Users, and visitors have visited the Site previously.

Standing alone, our cookies cannot and do not identify you personally. They merely recognize your Web browser.

Unless you choose to identify yourself to Chinook, either by responding to a promotional offer or opening an account, you remain anonymous to Chinook.

Cookies come in two flavors: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. They include such information as a unique identifier for your browser.

Chinook may use session cookies containing encrypted information to allow the system to uniquely identify you while you are connected. This information allows Chinook to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you have logged in and may be required in order to use Chinook Services. Should Chinook use persistent cookies, they can be read only by Chinook and will be used to identify the fact that you are an Chinook User or Subscriber or prior Chinook Web site visitor (whatever the case may be). We are especially careful about the security and confidentiality of the information stored in persistent cookies. For example, we do not store account numbers or passwords in persistent cookies.

Users who disable their Web browser's ability to accept cookies will be able to browse our Web site but may not be able to successfully use our Services.

Confidential User Data

Some Chinook Services are designed to facilitate the receipt, creation and/or storage of data by the user (“User Data”). Unless any such data can be shown to be already in the public domain, it will be considered Confidential (“Confidential User Data”). Chinook shall not disclose to any third party, or use for its own benefit or the benefit of any third party, any Confidential User Data, at any time before or after the date of this Agreement. User Data is not “Confidential” if such User Data (or portions thereof) (i) are lawfully obtained by Chinook from any third party; (ii) are generally available to the public or is later published or generally disclosed to the public by the User or the User’s lawful agents; (iii) are already lawfully in the possession of Chinook and are not subject to an existing agreement of confidentiality between the parties; or (iv) are independently developed by Chinook.

Third-Party Web Sites and Services

Chinook Web sites may contain links to other Web sites. Chinook is not responsible for the privacy practices or the content of other non-Chinook Web sites. Subscribers and visitors will need to check the policy statement of these other Web sites to understand their policies. Subscribers and visitors who access a linked site may be disclosing their private information through no action or fault on our part. It is the responsibility of the user to keep such information private and confidential.

Security

Our Site has security measures in place to help protect against the loss, misuse, and alteration of the Data under our control. When our Site is accessed using Microsoft Internet Explorer versions 6.0 or higher, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure that Data is safe, secure, and available only to you. Chinook may also implement advanced security methods that may be based on dynamic data and encoded session identifications. Chinook hosts its Web sites in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders. Finally, Chinook provides unique user names and passwords that must be entered each time a Subscriber or User logs on to our Services. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.

Opt-Out Policy

At any time after receiving information from us through electronic mail (or "e-mail"), visitors, Subscribers, and Users may opt-out of receiving further information from us, at a particular e-mail address, simply by sending an e-mail to support@chinookhosting.com, or by following the opt-out instructions set forth in an e-mail initiated by us; provided, however, Subscribers and Users may not opt out of receiving "transactional or relationship messages" as defined in, and initiated by us in compliance with, the CAN-SPAM Act of 2003, and associated regulations, as amended from time to time.

Correcting and Updating Your Information

If Subscribers or Users of the Chinook Services need to update or change registration information, they may do so by following the instructions provided in the online Help page for that Service. To update billing information, please use the same procedure or any other procedure that may be outlined in your Agreement. To discontinue the Service and to have data returned, please follow the procedures outlined in your Agreement.
